Is workers' compensation required in Illinois?+
Yes. Illinois law requires virtually all employers with one or more employees to carry workers' compensation. The IWCC enforces compliance and penalties for non-compliance can be severe.
What does workers' comp not cover?+
Generally does not cover injuries from intoxication, self-inflicted harm, crimes, or injuries outside the course of employment.
How is the premium calculated?+
Based on payroll, job classification codes, and claims history (experience modification rate). Accurate payroll reporting and a clean claims record keep premiums low.
Can I cover myself as a business owner?+
Sole proprietors and partners are generally excluded from mandatory requirements but may elect coverage. Corporate officers can also elect to exclude themselves.
What should I do when an employee is injured?+
Ensure immediate medical attention, document the incident, report to your carrier promptly, and keep records of all treatment and lost time.
What is an experience modification rate (EMR)?+
Compares your claims history to others in your industry. Below 1.0 earns a discount; above 1.0 increases cost. A strong safety record keeps your EMR and premium low.
